In-person tastings are back and privileges have changed
Now that things are returning to normal, your marketing team is poised to start generating out-of-state tasting events again. Do you know what the rules are now? The rules for tasting events can vary widely from state to state, and many privileges have changed in response to the pandemic. That's a lot to keep track of! So, how do you find the answer you need quickly? Simple. Just, log-on to The Digest website and check the trade practices section for the state where the event is planned. You may still have to consult with counsel or your compliance company, but it's always best to have an idea of the rules before even asking for advice. Shipping direct to Louisiana? Here’s what you need to know.
Louisiana DTC shipping license renewals will include a new requirement this year for those using fulfillment houses. And fulfillment warehouses now need to begin reporting. This recent development in Louisiana caught many by surprise. While updating The Digest we came across a change to administrative rules altering the out-of-state direct shipper permit application and renewal process. The Louisiana Office of Alcohol and Tobacco Control now requires out-of-state shippers to disclose the fulfillment house they use, and fulfillment houses are now required to report quarterly.  The new rule went into effect in August 2022. The ATC Out-of-state Shipper permits expire annually on December 31st and for those shipping from fulfillment houses, additional documentation will be required then. Good News for Tennessee DTC Shippers!
If you are considering getting a TN DTC shipping license, wait until after December 28, 2022. Earlier this year, the TN ABC started enforcing an overlooked rule requiring DTC shippers to register with the TN Secretary of State to obtain a new TN DTC license or renew an existing license. The fees and business tax associated with Secretary of State registration persuaded many wineries forego shipping to TN rather than comply.  The good folks at the CA Wine Institute have been working with the TN ABC on this issue and the TN ABC has now amended the direct shipping rules to remove the requirement of Secretary of State registration. The amendment will become effective on December 28, 2022.  Until the rule change is effective, applicants for new DTC licenses and existing licensees going through the renewal process are required to comply with the TN Secretary of State registration in order for their application to be processed.  For a demonstration of The Digest, view the vide
